Divorce is the legal ending of a marriage by a court that officially dissolves the bonds of matrimony between a couple in a particular country or state.
This refers to a parent's rights and responsibilities towards their child. They Include the right to have a child live with them, the duty to meet the child's basic needs (such as food and shelter), and the right to make certain decisions on the child's behalf.
Child visitation law governs the rights of non-custodial parents to spend time with their child. These cases are usually handled by state courts as part of broader family law proceedings dealing with issues such as divorce, separation, alimony, and child support and custody.
Child support is an ongoing payment made by a parent for the financial benefit of a child. It is an arrangement where a non-custodial parent makes monthly payments to the child's guardian. The payments go towards the child's needs, including food, shelter, medical services, transportation, and even entertainment. Child support usually lasts until the child turns 18 or graduates high school.
Also known as spousal support or maintenance, is a regular payment one ex-spouse may be required to pay the other after divorce or separation. It is a legal obligation to provide financial support to a spouse before or after legal separation or divorce. Alimony is paid from a supporting spouse to a dependent spouse most commonly in the form of recurring payments. The purpose of spousal support is to remedy any putative unfair economic effects caused by a divorce.
Mediation is usually a voluntary process, although sometimes statutes, rules, or court orders may require participation in mediation. Mediation is common in small claims courts, housing courts, family courts, and some criminal court programs and neighborhood justice centers. Unlike the litigation process, where a neutral third party (usually a judge) imposes a decision over the matter, the parties and their mediator ordinarily control the mediation process -- deciding when and where the mediation takes place, who will be present, how the mediation will be paid for, and how the mediator will interact with the parties.
Arbitration is one of various methods that together are referred to as alternative dispute resolution or ADR. As suggested by the name, the idea behind methods of ADR is to provide an alternative to filing a lawsuit and going to court, which is the traditional method for resolving legal disputes. Arbitration and similar alternatives were primarily designed to provide for a streamlined and cost-conscious option to deal with a legal issue. Below we'll take a look at when arbitration is an option, how it works, and how it differs from going to court.
Med-Arb is a form of arbitration in which the arbitrators starts as a mediator but in the event of a failure of mediation, the arbitrator imposes a binding decision.
Online dispute resolution (ODR) is a branch of dispute resolution which uses technology to facilitate the resolution of disputes between parties. It primarily involves negotiation, mediation or arbitration, or a combination of all three.
